    Please read these terms of use carefully before you start to use the site. By using our site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please refrain from using our site.

    The materials contained on our site are provided for general information purposes only and do not claim to be or constitute legal or other professional advice and shall not be relied upon as such. We do not accept any responsibility for any loss which may arise from accessing or reliance on the information on this site and to the fullest extent permitted by German law, we exclude all liability for loss or damages direct or indirect arising from use of this site.

    masteryourgolf.com is a site operated by Professional Golf Services UG (haftungsbeschränkt) (“We”, “PGS UG”,”Masteryourgolf.com”); we are a company registered in Germany under HRB 233279. Our registered office is at Friedenspromenade 87, 81827 Munich.  Our Tax number is 143/172/80751

 

  1. Accessing our site
    Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.

 

  1. Intellectual property rights
    We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it.  Those works are protected by copyright laws and treaties around the world.  All such rights are reserved. You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference and you may draw the attention of others within your organization to material posted on our site. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged. You must not use any part of the materials on our site for commercial purposes without obtaining a license to do so from us or our licensors. If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

    We aim to update our site regularly and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, and third parties connected to us hereby expressly exclude:

  • loss of anticipated savings;
  • loss of data;
  • loss of goodwill; and

for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

 

  1. Payment
    Payment processing services for Professional Golf Services UG (haftungesbeschränkt) on Masteryourgolf.com are provided by (but not limited to) Stripe. As a condition of Masteryourgolf.com enabling payment processing services through those providers, you agree to provide Masteryourgolf.com accurate and complete information about you and your personal data, and you authorize Masteryourgolf.com to share it and transaction information related to your use of the payment processing services provided by those providers.

 

  1. Billing and Cancellation

 

Billing Cycle. The membership fee for the Masteryourgolf.com service and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged based on the subscription you have selected. In any event, the subscription is charge at the start of the subscription for a full cycle (monthly, bi-yearly or yearly). In some cases, your payment date may change, for example if your Payment Method has not successfully settled or if your paid membership began on a day not contained in a given month. Visit our website and click on the “Subscription” link on the “Settings” tab to see your next payment date.

Cancellation. You can cancel your Masteryourgolf.com membership at any time, and you will continue to have access to the Masteryourgolf.com service through the end of your current billing period. To the extent permitted by the applicable law, payments are non-refundable, and we do not provide refunds or credits for any partial membership periods or unwatched Masteryourgolf.com content. To cancel, go to the “Subscription Button” in the Settings-Tab and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of your current billing period. To see when your account will close, click “Subscription Button” on the “Account-Tab” page.

Changes to the Price and Service Plans We may change our subscription plans and the price of our service from time to time; however, any price changes or changes to our subscription plans will apply to you no earlier than 30 days following notice to you.

 

  1. Information about you and your visits to our site
    We process information about you in accordance with our privacy policy.  By using our site, you consent to such processing and you warrant that all data provided by you is accurate.

 

  1. Viruses, hacking and other offences
    You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.
    By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
    We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

    Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only.  We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.  When accessing a site via our website we advise you check their terms of use and privacy policies to ensure compliance and determine how they may use your information.

 

  1. Updates To Privacy Policy and Terms of Use.
    We may change this Privacy Policy from time to time to reflect new services, changes in our Personal Data practices or relevant laws. The “Last updated” legend at the top of this Privacy Policy indicates when this Privacy Policy was last revised. Any changes are effective when we post the revised Privacy Policy on the Services. We may provide you with disclosures and alerts regarding the Privacy Policy or Personal Data collected by posting them on our website and, if you are a User, by contacting you through your MasterYourGolf Dashboard, email address and/or the physical address listed in your MasterYourGolf account.

 

  1. Cancellations
    Cancellations can be made at any time of the membership without penalty. To cancel your subscription simply go into your account settings and press the ‘unsubscribe button. Your cancellation will be activated immediately within the respective subscription you have selected while subscribing to our system.
    In the event of cancellation, a membership before its contractual ending, you will have access to your account until the displayed termination date.

  1. VAT
    All prices contain locally applicable VAT and will be paid by Masteryourgolf.com in accordance with the relevant, local authorities.

 

  1. Miscellaneous
    Governing Law. These Terms of Use shall be governed by and construed in accordance with the laws of the Germany. These terms will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence. Masteryourgolf.com will not participate in an alternative dispute procedure before a consumer arbitration board and does not have a legal obligation to do so.
    Unsolicited Materials. Masteryourgolf.com does not accept unsolicited materials or ideas for new content, and is not responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to Masteryourgolf.com.
    Customer Support. To find more information about our service and its features or if you need assistance with your account, please visit the Masteryourgolf.com FAQ on our website.
    Survival. If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.
    Electronic Communications. We will send you information relating to your account (e.g. payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration.
